Default Legality of Outdoors Smoking?

Hey HP!
I'm thinkin about taking a few friends of mine to the Oregon Coast for my birthday for a few nights. And my question to you is, can we get in trouble for hookah-ing out on the beach, taken no minors are smoking and we're more then 10 feet away from any building/door/vent.
What say you!

If there are no minors & if its a non-public beach you should be fine

And if it is public?

And what would be such punishment for smoking on a public beach?

At the resort that I am staying at, there's always people smoking on their back patios.

If cigarette smoking is allowed on the beach, than there will be no problems with smoking hookah.

And the last question. What if there are minors in our group, but not smoking?

As far as i know and read it in other storys on this forum it is not allowed. Like "the open bottle rule" in the car, or something like that if i'm correct Try to search on it, but i know one of our members had problems with cops when he was smoking with minors.

Here's a few stories I've found

http://www.wate.com/Global/story.asp?S=10117972 - Failed

Quote:
Workplaces and public places that must be smokefree include but are not limited to:
Bars and taverns, including bar areas of restaurants
Bowling centers
Bingo halls
Private and fraternal organizations
Employee break rooms
Restaurants
Private offices and commercial office buildings
Retail and wholesale establishments
Manufacturing plants and mills
Truck stops
Child and adult day-care
Assisted living facilities
Movies theaters and indoor entertainment venues
Hotels and motels (Exception: up to 25% of guest rooms may be designated as smoking rooms by the owner or entity in charge)
Work vehicles that are not operated exclusively by one employee
Quote:
Smoking in hotel or motel rooms that specifically allow for smoking. The owner or entity in charge of a hotel or motel may designate up to 25% of sleeping rooms as rooms in which smoking is permitted.
If the owner or entity in charge of a hotel or motel chooses to designate up to 25 percent of sleeping rooms as smoking permitted, all smoking rooms on the same floor must be contiguous and the status of the rooms may not be changed, except to add more nonsmoking rooms.
The owner or entity in charge of a hotel or motel must notify clients upon check-in as to the smoking status of the rooms.
All hotel and motel sleeping rooms must be clearly marked either smoking or non-smoking on the exterior door of the sleeping room.

Public beaches have signs on the entrances to them of what you cannot do usually.

If there exists nothing about smoking, then you are fine...EXCEPT if there is a no glass law.

Then you might actually have use for that mya acrylic.

idk how the laws are there but here they would be no reason to not allow it other than if a cop is stupid and thinks its NHT, which usually can be cleared up by showing the box of tobacco.

honestly though i think it would be more of a hassel to smoke out at a beach or park unless you are camping out there, i would love it but if its me i would probably stick to cigars or western pipes

photolinger nailed it. you probably will be able to smoke but i can see people freaking out and thinking your doing something illegal, you'll most likely have to explain what it is to local authorities if they confront you

If it is your back patio of your own room in the resort you would be fine. Especially in Oregon, they are very liberal there, which is great .

I would call and ask the resort though, just to make sure. They might need to be enlightened on what a hookah actually is.

I just stick to smoking in my home. I can't be bothered to smoke in public. How do you enjoy smoking when you have to explain all the time what you are doing and yet they don't believe you. It really pisses me off when they call it a b--g.

This topic has made me want to take my rig to Hyde Park and enjoy this beautiful weather we've been having lately over here in London.

I have had police come and after a "concenred citizen" called them on me and the girl i was with for smoking in public. It was in the hills outside Corvallis, OR and he didnt cite us or tell us we werent allowed. So, it isnt illegal to smoke hookah in public in Oregon. Different rules may apply to parks and beaches though. Maybe you should call the park and recreation department for the county you will be in and ask them?

Another recommendation, bring the original tobacco container(s).

I've smoked on a public beach recently. We dug a hole deep enough for the hookah to sit in and laid a sheet over the hole, then placed the hookah in it.. It worked out well, and the only thing that was exposed were the hoses.. Nobody seemed to pay any mind.

There is a sure-fire way to find out if its legal. Bring the Hookah and a Boombox blasting "Fuck the police" in the first 5 mins when 20 cops show up you can ask the fuzz if it's legal or not.

Well somewhere like a beach works as long it doesn't have the no smoking sign i think. I was freakin smoking on the sidewalk on broadway in NYC with a security camera watching us for a whole night haha
