Default Smoking Ban in Michigan

Everywhere in Michigan all places of business are going smoke free. Of course places like cigar bars, casinos, and hookah lounges are given a pass but as I understand it you can not get a food license if you own one of these three businesses. This is a big blow to places that prepare things like coffee, tea, and foods in lounges. As I understand it you can't even give people cups of water if you don't have a food license.

we've had a smoking ban in new york and new jersey for a few years now, it didnt effect much, just more people outside smoking, and here you always needed a license to serve food, and im pretty sure a different license to serve dairy

Ya you have to have a license in MI. The problem is they are not going to allow you to get a license if you are a smoking business. Plus they are taking away the licenses we already paid for that cover this whole year. It's crap.

And they wonder why the Michigan economy is shooting downhill like a runaway rollercoaster . . . politicians . . . I was led to believe that as long as your business income was at least 80% from tobacco and/or tobacco related products that you could maintain the status. However, the removal of all food related licenses is new to me. That really sucks. Just one more reason why, as soon as I am able, about two years down the road, I am heading out of Michigan as fast as I can and not looking back . . . I say, let her fall. The MI gov is gonna absolutely kill any possibility of this state ever coming out of the financial mess it's in anyway. I mean, come on . . . the small business tax that what, only MI and a couple other states still pursue . . . just one more reason to NOT do business in MI. Seez ya.

Chicago went smoke free and it didn't affect much. It was more the hassle in the winter to go outside than anything. It does seem bogus to revoke permits and licenses though.

This is the same crap as in Illinois where they banned Hookahs in establishments that served food and liquor. This law caused many places to shut down or about to shut down at a time where jobs are scarce and tax collection is in the dumps.

They can't serve food and provide smokes at the same time. That's pretty ridiculous considering hookah is the only smoking I know of that it's customary to do both. In Michigan too, which is strange, since they have a rather high Arab population.

You could smoke at home but thats not the point. This law kills business. Arabs do not just go hookah lounges just to smoke Argileh alone and cigarette smokers do not like Argilles. Its a culture thing and most like myself prefer to go out to a food/entertainment establishment and have some food, drink a beer, puff on a hookah and listen to live music.

In Illinois this type of law used to be local and some towns/suburbs started to band cig. smoking in local food establishment since some are liberal and some are not but those owners complained that people would just go to the next town where smoking is allowed. Thats when the polititian decided to do statewide ban and that included bars and nightclubs. In Michigan, places like Dearborn are majority Middleastern population and they are getting screwed by this law.

I would think that they could put some ind of by-law, or waiver set aside for places catering to a lounge/restraunt bar/grill etc. Where patrons entering the establishment except that there is customary smoking i.e hookahs in said establishment. Just a possiblility that the people could try to add if this is passed.

I don't like the road this country is going down from DC to the individual states a few hundred politicians are holding the country hostage to special intersts. Vote them all OUT.

my heart goes out to those of you who have to put up with this crap. Sadly the tobacco hate machine continues to roll down our nation. Has anyone tried calling mayors, congressmen, the senate on this. Maybe someone should tell these lawmakers to stop being wussy's and crack down on things like job outsorcing, home invasions, and shoddy buisness practices that are desighned to make sure that products you paid good money for, break as soon as they can so to spend even MORE money... Yeah come to think of it, tobacco is the evil of the world and needs to be wiped off the face of the u.s. Instead of being held as a time honored tradition loved by those that yern for a life of culture inlightenment and relaxation... Sorry to get flustered like that. Once again sorry to hear about the trouble Michigan

Being from and currently living in Michigan, yeah, it does suck. However, it is just one more notch in the political machines moves that are so crippling this state. The highest unemployment rates in the country. Business and industry almost running to get away from the over-burdening small business tax laws and extreme over-regulation of, well, I hate to generalize, but just about everything. All I can say is that I'm stuck here in this muck-hole of a state for about another two years till my daughter graduates and then, like the business and industry, I'm running like hell to get as far from Michigan as I can. Smoke happy.

I can see why a "smoking ban" should keep smoke out of restaurants...But if your business is designated as a "hookah lounge", whether there is food or not should be irrelevant. It's quite insulting to the very culture and tradition behind it. It's like telling bars they can either serve alcohol, or broadcasting sporting events, but not both The state collects a substantial amount of tax from such venues, right? Why, at this particular time, would they want to cripple such businesses? Last time I checked, MI was in an entire dimension of hurt financially.

Is this public-driven legislation? Or just politicians picking on "problems" they are big enough to "solve"?

they did the same thing in the uk, a out right ban in smoking in public places like shops and resteraunts,but there was away around this..... all you had to do was take a sledge hammer and smash down one of your wall, coz that changed it from an enclosed area to an open space, every shisha place has done it, AL FRESCO SMOKIN :P

I used to live in the suburbs of Detroit and there are several cities with high Arab populations.
Dearborn, MI (that's where the Detroit Airport is) for example has the highest Arab population in the US. They also have hookah delivery services there.

I'm sure there's gotta be some loophole there to get around it. Maybe part the restaurant into a eating room and a smoking room?

I can understand that some people do not like smoke and yes there should be places where people can sit down and eat without inhaling second hand smoke, for example children and pregnant women. The problem was resturaunts had smoking sections but those weren't really enclosed or isolated so it was sort of useless. Next thing you have to worry about is taxes. I am not a regular smoker but I feel for people who smoke on a regular basis (i.e cigarettes). A pack of Marlboro now cost $8.5 in the city of Chicago.

There is hookah lounge near where I live and it is located in a strip mall. The owne(s) just "happened" to own the "Take out" resturaunt next door so before you go into the lounge stop by next door, order food, pay for it and they deliver it next door to your table.
